Invitation to current and former employees and contractors of State sector agencies to talk directly to the Royal Commission

1. The Royal Commission invites current and former employees and contractors of the following State sector agencies to approach it if they believe that they can assist its inquiry (“relevant state sector agencies”)

2. The Royal Commission will keep the list of relevant State sector agencies under review and may add additional agencies to it in the future.

3. The Royal Commission has discussed with the chief executives or equivalent of each of the relevant State sector agencies that it would publicise an invitation to current and former employees and contractors of those agencies to provide submissions or evidence on matters within the Royal Commission’s terms of reference. The Royal Commission has had an assurance from the chief executive or equivalent of each of the relevant State sector agencies that current and former employees and contractors of their agencies should feel free to make submissions and evidence to the Royal Commission.

4. In addition, each relevant State sector agency has assured the Royal Commission that it will not:

• initiate any disciplinary action against any of its current or former employees or contractors on the basis that giving in good faith evidence or submissions to the Royal Commission is a breach of their employment agreement/contract; or

• discriminate against any current or former employees and contractors because they give in good faith evidence or submissions to the Royal Commission.

5. Any current or former employee or contractor of a relevant State sector agency who would like to take up the Royal Commission’s invitation may do so in private, as the individual sees fit. Any individual who seeks confidentiality and/or anonymity may request that upon their first contact with the Royal Commission. Any individual who wishes to refer to classified material can do so by following the relevant process, which is available from the Royal Commission or from the relevant state sector agencies.

6. Current or former employees or contractors of a relevant State sector agency who wish to give evidence or make submissions, are reminded that the Royal Commission is limited as to the scope of its inquiry – the limits are set out in its Terms of Reference. The Royal Commission also draws attention to Minute 1: Procedures for Gathering Information and Evidence(external link) issued on 13 May 2019 outlining its preliminary view that the inquiry will be conducted largely in private.

With regard to Inland Revenue current and former employees and contractors, these assurances are given on the basis that no “sensitive revenue information” is released and that any “revenue information” is only released following the relevant legislative requirements and process which are available from the Royal Commission or from Inland Revenue.
